Domain Name Transfer Agreement

This Domain Name Transfer Agreement ("Agreement") is by and between Nics Telekomunikasyon A.S. ("NicProxy") and you, your heirs, agents, your reseller and assigns ("You"), and is made effective as of the date of electronic execution. This Agreement sets forth the terms and conditions of Your use of NicProxy's Domain Name Transfer, and represents the entire agreement between You and NicProxy. This Agreement governs the use of, and sets forth the policies of NicProxy for all the Top Level Domain ("TLD") including the Generic Top Level Domain ("gTLDs") and Country Code Top Level Domain ("ccTLD") transfer policy and procedures adopted by NicProxy.

NicProxy is a registrar bound by an agreement between NicProxy and the Internet Corporation for Assigned Names and Numbers ("ICANN") and NicProxy may modify this Agreement in order to comply with applicable law and the terms and conditions set forth by ICANN and/or the Registry Administrator chosen by ICANN, as well as any registration rules or policies that may be published from time to time by NicProxy.

NicProxy and/or NicProxy's Resellers will be contacting the Administrative Contact's email address for transfer approval. The transfer will only be initiated upon approval from REGISTRANT Administrative Contact. Once initiated, a transfer will be accepted or denied by the losing registrar within 5 days.

NicProxy may choose to accept or reject REGISTRANT domain name transfer application for any reason at its sole discretion. Rejections may include, but are not limited to the followings:

  • losing (current) registrar rejected the transfer.
  • the original registration took place less than sixty (60) days prior to the transfer request.
  • domain name under locked status by either Registry or losing registrar.
  • domain was transferred to NicProxy for less than sixty (60) days prior to the transfer request.
  • domain name expired and not renewed.
  • domain name expired and renewed during the forty-five (45) day grace period, which the 45 days grace period has not yet passed.
  • Registrant information has changed for less than sixty (60) days prior to the transfer request.
  • pending bankruptcy of Registrant.
  • dispute over the identity of Registrant.
  • situation described in the Dispute Policy.

Upon successful transfer, NicProxy shall become the Registrar of the Domain Name Record. There will be no change for the Registrant information for the Domain Name and registration will be automatically extended by one (1) year. If a Registrar Transfer would extend the existing Domain Name Registration beyond ten (10) years, in such instances you will be required to pay us the applicable Registration Fee for an additional year term, but the un-expired term of the Domain Name Registration will only be increased to a maximum of ten (10) years. Domain name registration transfers may only be initiated once payment is made and the Administrative contact has responded positively to Domain Name Transfer confirmation email asking for permission to transfer. The Domain Name Transfer confirmation email will be sent to the Domain Name(s) Administrative Contact as identified in the WHO-IS database. The Administrative Contact will be acting on behalf of the Registrant and has legal authority to initiate this transfer request. Registrant is responsible for updating the Administrative Contact's email as identified in the WHO-IS database.

For a Domain Name Transfer that has been recently renewed, it could have the potential which the renewal year will be lost in the event that the domain name was renewed during the forty-five (45) day grace period after the expiration date which the forty-five (45) days grace period has yet to expire. As a result, NicProxy will not be responsible for the lost year and NicProxy will not credit that year to the domain. NicProxy will not intervene in the recovery of any such lost registration years that occur during the transfer of REGISTRANT's domain name.

NicProxy will not be liable for: Any suspension or loss of the domain name registration in Registrant's Name, whether or not authorized by Registrant to have such use interruption of business access delays or access interruptions to this site or the web site(s) Registrant access by the domain name registered in Registrant's name data non-deliver, mis-delivery, corruption, destruction or other modification events beyond NicProxy's reasonable control for the processing of this application of the domain name transfer.

NicProxy's Resellers also acknowledge that internal transfers, which can be defined as Reseller to Reseller Domain Names Transfers, are legally bound by this Agreement and associated agreements.

By entering in the Domain Name Transfer process with NicProxy Registrant acknowledges that the Domain Name will be bounded by NicProxy Domain Name Registration Agreement and to be legally bound by the agreements that govern all domain names registered through NicProxy as found on www.nicproxy.com/terms.asp, including the Domain Name Registration Agreement; the Uniform Domain Name Dispute Resolution Policy and any NicProxy Agreements, policies and procedures that are or may be published from time to time by NicProxy, ICANN, and/or the Registry Administrator chosen by ICANN.
